Terms of service
In effect 6 October 2026.
These terms are an agreement between you and Switchyard Software Company, which operates Abatement Desk. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you are saying you have the authority to bind it, and "you" below means that company.
1. Who we are
Abatement Desk is a service for preparing and keeping track of asbestos abatement notifications. It is operated by Switchyard Software Company, and "we" and "us" below mean Switchyard Software Company.
2. What the service does, and what it does not
The service helps you prepare notifications, keeps your filings and their history in one place, tracks what is due, and checks your entries against the filing rules before you submit.
We do not file on your behalf. You submit your notification to the state yourself, through the state's own system, the same way you do today. Nothing is transmitted to a regulator by us or on your account without you doing it. Where the service can pre-fill a form in your own session, you remain the one who reviews and submits it.
This is not legal or regulatory advice. The deadlines, fees and rule references the service shows you are our reading of published regulations, provided to help you work. They are not advice, they are not a substitute for your own judgment or your lawyer's, and we are not your compliance department.
Compliance stays yours. You remain responsible for filing accurately and on time, for the truth of what you file, and for meeting every obligation the law puts on you. A reminder we fail to show, a rule we read wrongly, or an outage on our side does not move that responsibility to us, and you should not run your compliance in a way that assumes otherwise.
3. Your account
You need an account to use the service. Give us accurate information and keep it current. You are responsible for what happens under your account, including everything the people at your firm do with it, so keep access under control and tell us promptly if you think someone has got in who should not have.
You must be at least 18 and using the service for a business.
4. Your information, and the public record
What you put into the service stays yours. You give us permission to store it, process it and display it back to you and to the other people at your firm, which is what running the service requires. We do not claim ownership of it and we do not sell it.
Some of what appears in your account comes from the state's published records rather than from you, because asbestos notifications are public. A firm's notifications appear in your account once the firm is added to it. You can also tell us a firm is yours, and we check that against public business records. Telling us a firm is yours when it is not is a breach of these terms.
We may use information about how the service is used, in a form that does not identify you or your firm, to improve it.
5. What you may not do
Do not use the service to break the law. Do not file, or prepare to file, anything you know to be false. Do not try to get at another firm's data, probe or interfere with the service's security, scrape it in bulk, resell access to it, or use it to build a competing product.
6. Fees and billing
Subscriptions are billed monthly in advance. The current prices, and how the amount is worked out, are on our pricing section, which is part of these terms by reference. We have deliberately not repeated the figures here so that the two cannot disagree.
Payment is taken by our payment processor. Fees are stated exclusive of tax, and you are responsible for any tax due on them.
The price follows your filing volume. You do not pick a plan. We set your price from the notifications attributable to your firm, and we re-check it periodically and move it in either direction to match, as described on the pricing section. Your subscription renews automatically each month at the then-current amount until you cancel.
If a payment fails we may suspend the account until it is settled.
7. Cancelling
Cancel whenever you like, from your account or by emailing us. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We do not refund part-months, except where the law says we must or where we have plainly got something wrong, in which case ask and we will sort it out.
Before you go, you can download any document you have added from its page under Documents. After the account closes we keep your data for a while and then delete it, as described in the privacy policy.
8. Availability
We aim to keep the service running and we do not promise it always will be. It may be down for maintenance, or because something has broken, or because a service we depend on has. We do not currently offer a service level agreement, and if that changes we will say so here rather than leave you to find out.
Because the service does not file for you, an outage does not stop you filing. The state's own system remains available to you and using it is always an option.
9. Warranties
The service is provided as it is. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error free, or that every rule reference, deadline or fee it shows you is correct, and you should not treat it as the last word on a regulation.
10. Limitation of liability
To the extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost business, however caused.
To the extent the law allows, our total liability arising out of or relating to these terms or the service is limited to the amount you paid us in the twelve months before the event that gave rise to the claim.
Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You will defend and indemnify us against claims brought by a third party arising from your use of the service in breach of these terms, from anything you file, or from your infringement of someone else's rights. We will tell you promptly about any such claim and let you control the defence, and we will not settle it without your agreement.
12. Changes
We may change the service, and we may change these terms. If a change materially affects you, we will give you reasonable notice by email or in the product before it takes effect. Carrying on using the service after that is how you accept it. If you do not accept it, cancel.
13. Suspension and termination
We may suspend or close your account if you breach these terms, if your use puts the service or other customers at risk, or if payment goes unmade. Where the circumstances allow it we will warn you first and give you a chance to put it right. You may close your account at any time under section 7.
14. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. The state and federal courts located in Pennsylvania have exclusive jurisdiction, and both of us consent to that.
15. The rest
These terms, with the privacy policy and the pricing section they refer to, are the whole agreement between you and Switchyard Software Company about the service. If a provision is held unenforceable, the rest stays in force. Not enforcing something once does not waive it. You may not assign these terms without our consent; we may assign them to a successor to the business.
